General terms and conditions

1. Introduction.

1.1 This agreement sets out the General Terms and Conditions (hereinafter “T&C”) for the contractual relationship between Globapokerdeals and any person registering with us, whether an Affiliate/Agent or a direct customer/individual player (hereinafter “The User”, “You”).

1.2 Each User is bound by these terms and conditions upon registering for an account with Globapokerdeals and is bound by them throughout the existence of the relationship.

1.3 The contractual relationship between the registered User and Globapokerdeals is governed by and construed in accordance with these Terms and Conditions.

1.4 In the event of any dispute between the English version of the General Terms and Conditions and the versions in other languages, the English version shall prevail. Any other information on this website or on the Affiliates’ websites may be presented in other languages, but only for information purposes.

1.5 It is recommended that you print a copy of these Terms and Conditions for your records and keep them in an accessible place.

2. 2. Changes to the Terms and Conditions

2.1 The Terms and Conditions may be changed from time to time for a variety of reasons including, but not limited to, commercial reasons, compliance with laws or regulations, instructions, guidance or recommendations of a regulatory body, or for customer service reasons. Any changes will be communicated to you by the following methods: email (to the email address you have previously provided to us) via the Globapokerdeals newsletter and a notice on the website.

You are requested to ensure that you have opted in to the email service.

2.2 Changes apply with immediate effect upon posting.

2.3 If You continue to use Globapokerdeals products/services and/or Your account after notification, You will be deemed to have accepted and are bound by the new T&C, including any additions, deletions or substitutions.

2.4 If any change is unacceptable to You, You may stop using our products/services and/or close Your account.

3. Privacy Policy

4. Account Rules

4.1 You must be at least 18 years old. Entries by minors are permitted.

4.2 Residents of jurisdictions that prohibit online gambling may NOT register as Globapokerdeals users.

4.3 Fraudulent, multiple or incorrectly completed entries will not be accepted. The same applies to entries made in violation or breach of these Terms and Conditions.

4.4 Globapokerdeals is not responsible for entries that have not been received correctly for any reason.

4.5 To open an account with Globapokerdeals, the prospective user must correctly fill out the registration form on the website and read and accept the T&amp;C found on the website (www.globapokerdeals.com). During registration, the user must provide Globapokerdeals with his/her correct full name, address and email address. The user agrees to update this information in the event of any changes to his personal data provided.

4.6 Globapokerdeals may, at its own discretion and without having to provide any justification, refuse to open an account.

4.7 Globapokerdeals reserves the right to close your account and to refund your available balance at its absolute discretion and without any obligation to state a reason or give prior notice.

4.8 During the registration process you will be able to choose your username and password. The password may be changed by the User at any time. The User must keep the username and password secret at all times.

4.9 Globapokerdeals reserves the right to exclude new participants from its services, promotions, trainings, events and from using its website at any time, particularly if Globapokerdeals has evidence that a participant has tried to register using more than one username or is involved in any fraudulent or illegal activity, such as, but not limited to, money laundering and chip throwing.

4.10 Globapokerdeals reserves the right to examine and confirm the identity of its users.

4.11 You agree that you will not be allowed to publicly promote Globapokerdeals offers, for example by posting them in a forum, without our prior written approval.

4.12 Affiliates of Globapokerdeals products, services and offers will be responsible for their sub-affiliates and players (Direct Users) and will be billed in case of any negative revenue, chargebacks, overpayments or late payments generated through them. Globapokerdeals reserves the right to charge the primary affiliate for any fraud, network violations and fines caused by their respective sub-affiliates.

4.13 Withdrawal Policy: Withdrawals are only possible 2 weeks after registration. No retractions will be allowed if the player already has an active poker account with us. Please email us to review each case.

4.14 The decision of Globapokerdeals in relation to any dispute shall be final and subject to our final decision.

5. Payments

5.1 Commission/bonus due to Users (affiliate commission and/or player bonuses) will be paid by Globapokerdeals via EUR or USD Skrill, Neteller or Ecopayz on or before the thirtieth (30th) day of each month for the commission/bonus accrued during the immediately preceding calendar month. Such payment shall be accompanied by a written statement detailing the calculation of the commission/bonus. If the commission/bonus payable to the User for any calendar month is less than USD or Euro 100, then Globapokerdeals shall withhold payment until the total amount due is at least USD or Euro 100.

5.2 All payments shall be made in Euros or such other currency as may be determined by Globapokerdeals in accordance with the currency received.

5.3 Globapokerdeals reserves the right to withhold any commission generated by referrals who identify themselves as existing customers.

5.4 The Affiliate is responsible for accounting for any VAT deemed due on commissions earned on their commissions received.

5.5 Globapokerdeals reserves the right to adjust commission/bonus payments to reflect overpayments, currency conversions, new customer chargebacks and/or credits or underpayments by Globapokerdeals at any time, including retroactively for 6 months. In such event, any other revenue generated and commission will be settled accordingly.

5.6 In the event that Globapokerdeals does not receive at all, only in part or late payment from any operator/business partner, it shall not be responsible or liable in any way to pay affiliate commission and/or player bonuses until payment has been properly received.

5.7 In the event that Globapokerdeals can provide reasonable evidence that any fraud has occurred, either by the affiliate, by one of its customers or by another user (player), Globapokerdeals reserves the right to withhold any commission/bonuses accrued until the matter is fully cleared up.

5.8 Users shall be responsible for updating their payment information in the Edit Profile menu panel in a timely manner. In the event that Globapokerdeals is not in possession of the User’s payment information within sixty (60) days after the end of the respective calendar month in which the commission would have been earned, such commission and bonus payment will be forfeited.

6. Follow-up

6.1 The tracking of your poker account is confirmed once the tracking status has been updated in your account with our website.

6.2 After the update, you will receive a confirmation email. Users will be responsible for ensuring that all registration details are sent correctly, e.g. skin usernames and percentages of trades.

6.3 You should not start playing before the tracking has been confirmed.

6.4 Globapokerdeals can NOT guarantee the tracking; which means that, if for some reason, the tracking status has been confirmed although Globapokerdeals does not receive payment from its partners for the account, Globapokerdeals will not be responsible or liable to pay any commissions or bonuses.

6.5 Globapokerdeals reserve the right to track both your Skrill and Neteller accounts and update them in their respective VIP programs.

6.6 By submitting Your player account details in our backoffice, You agree that Globapokerdeals will share and request Your personal information such as username, nickname, email address and other personal data with our affiliated operators and poker rooms.

7. Suspension and account closure

7.1 Globapokerdeals reserves the right to suspend or close Your account at any time and for any reason, including but not limited to the circumstances set out in these Terms and Conditions.

7.2 User accounts may be specially closed by Us at any time, if We suspect that You are engaged in prohibited or harmful practices, such as, but not limited to, collusion, cheating, fraud, criminal activity or any action in bad faith or which is detrimental to the conduct of Our business.

7.3 When You breach the T&amp;Cs, We may, prior to any suspension or termination of Your account, notify You (using Your contact information provided) that You are in breach, requiring You to stop the relevant act or omission, and/or requiring You to correct an act or omission on Your part.

7.4 Regardless of whether We suspend or terminate an account, We may decide to cancel and void any outstanding commissions and bonuses at Our absolute discretion where a technological failure occurs or where You have breached any of the T&amp;Cs in this Agreement.

7.5 Upon suspension of Your account for any reason:

7.5.1 No activity (including deposits, withdrawals, games, income generating bets or commissions) will be permitted until the date it is reactivated by Us.

7.5.2 No commissions/bonuses will be credited to Your Account.

7.6 Upon closure of Your account due to breach of these Terms and Conditions:

7.6.1 All commission/bonus payments due will be voided and forfeited by You.

7.6.2 Globapokerdeals reserves the right to withhold funds from Your account until it is determined that an investigation has been conducted and/or they have been forfeited.

8. Intellectual Property Rights

8.1 Globapokerdeals owns all intellectual property rights, including but not limited to copyrights (including software copyrights), database rights, trademarks, domain names, know-how and any other rights relating to its products and services or the software necessary to use them. All intellectual property rights created and/or derived from this agreement, including but not limited to advertising material, banners and new customer data, shall be or become the exclusive property of Globapokerdeals.

8.2 Under no circumstances shall your use of the Website or the Globapokerdeals Services grant you any interest in any intellectual property rights owned by us or any third party.

8.3 You must not, and must not permit any other person to copy, store, publish, rent, license, sell, distribute, alter, add to, delete, remove or tamper with the Website, any part of the Website including any copyright, patent, trademark or other proprietary rights notices placed on the Website, any proprietary software which compromises the Website and/or any software made available for download without our prior written consent.

9. Liability

9.1 Globapokerdeals is only liable for the gross negligence or wilful misconduct of its management, employees or regional managers.

9.2 Globapokerdeals is not responsible for the services, pages or content of websites that can be accessed through links from the Globapokerdeals website.

9.3 Globapokerdeals is not responsible for the consequences caused by the failure of any device or software, managed directly or outsourced, which may cause a total or partial reduction of access to its services.

9.4 Globapokerdeals accepts no liability for any damage to a User or a third party resulting directly or indirectly from an error, a typo, a malfunction of the software of the website of Globapokerdeals or any of its affiliates and/or partners.

11. Applicable Law and Jurisdiction

11.1 The English text of these Terms and Conditions shall be the only authentic and binding version, even if the text is translated into other languages. The headings of these T&amp;C shall not affect their interpretation.

11.2 In the event that any provision of these Terms and Conditions is held by any competent authority to be unenforceable or invalid, the relevant provision shall be modified to allow it to be enforced in accordance with the intent of the original text to the fullest extent permitted by applicable law. The validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected.
